E-1 Visa

The E-1 visa is a non-immigrant visa that allows foreign nationals from countries that have a treaty with the United States to enter the country for the purpose of conducting international trade. Depending on the country of nationality, the visa is valid for up to five years and can be extended indefinitely as long as the substantial trade continues.

REQUIREMENTS

To qualify for an E-1 visa, the applicant must be a national of a treaty country, the trade must be substantial, and the majority of the foreign trade must be between the United States and the treaty country. Additionally, the applicant must be coming to the United States to engage in the trade, either as an employee of a qualifying organization or as the owner of the qualifying organization.

DEPENDENTS

The E-1 dependent visa allows spouses to obtain work authorization and children under 21 to attend school in the United States. The dependent spouse does not need to apply for a separate Employment Authorization Document, it is valid with the E-1 dependent visa and upon entry into the US with that visa.
